Committee Guide to Management Rights Transfers (QLD)

If you have a building with management rights it is inevitable that at some stage the body corporate will be asked to consent to the assignment of them.

  • Who does what?
  • What does the body corporate have to do?
  • Does the body corporate have to say yes?
  • What is this Gallery Vie all about?

All of those questions and plenty more are answered in the only guide published by expert body corporate lawyers Hynes Legal.  This is the definitive guide for committees when considering the assignment of management rights agreements.

I would like to know if a Body Corporate in Queensland can legally sign an agreement with the building managers which restricts owners rights to self manage short term rentals. Can you advise who I can talk to about this matter?

I am not aware of this having been tested legally, but I think the better argument is probably yes. A body corporate can authorise a letting agent and it can do so on certain terms and conditions. One of those may well be the type of tenant the manager will manage. Where it definitely cannot be is in the by-laws.
