LAW REFORM – SUBMISSIONS CLOSE TOMORROW!

On 24 August 2023 the Hon Yvette D’Ath MP, Attorney-General and Minister for Justice and Minister for the Prevention of Domestic and Family Violence introduced the Body Corporate and Community Management and Other Legislation Amendment Bill 2023 into the Queensland Parliament.

The Bill was referred to the Legal Affairs and Safety Committee for detailed consideration.

The committee invites submissions on any aspect of the bill, from all interested parties, which close 5:00pm Saturday, 2 September 2023.

    I think that the amendments are sound.However you need to look at the issue of pets in apartment blocks
    I notice the profusion of dogs particularly on the Gold Coast fast becoming a public health issue. An apartment is the wrong environment for most pets especially dogs larger for obvious reasons and smaller because of the constant yapping.
    Our public areas are even now toilets for these animals.
    You need to allow stronger policing of pet banning, and enforcement of rules where pets are allowed.

    Amazing! We get told repeatedly that the “pub test” for correct behaviour within the Body Corporate industry is “being reasonable”.
    I got an email from the BCCM Dept of Justice late Monday re submitting comments on these extensive amendments. We had 5 days to respond. Is that “reasonable”?
    The reference is to “animals of any number, type or size “entering” a building or common property,” not pets being allowed to “live” on strata sites under fair conditions. What exactly does “animals entering the site” mean to owners and residents???? Does that seem reasonable?
    A recent smart strata article from the Deputy Premier could not be responded to. Is that reasonable?
    Any concerned person needs to summit asap re the current amendments and ask for a “reasonable” extension to the time frames in order to put forward their “reasonable suggestions” on the industry where they are major stakeholders and the people most effected.

    The 2nd September 2023 is not a reasonable time to give respondents time to comment on these amendments. If you are claiming to be reasonable you need to offer more time for comments.

    Having expressed my concern that owners were not consulted and afforded an opportunity to make submissions, I was pleased to receive, on Monday 28 August 2023, an email advising ‘The LASC invites you to have your say by making a written submission. The closing date for written submissions is 5:00pm Saturday, 2 September 2023.’

    I will of course comply to the best of my ability but am disappointed that we have not been afforded ‘reasonable’ time in which to provide written submissions. In fairness to ALL body corporate ‘owners’, the time to respond should be extended and allow those owners who have made hasty submissions, an opportunity to more respond more comprehensively.

    No time given for usefull submission, I am just seeing this and it is closed. I assume they do not want much feedback. I for one am tired with the Government interfearing in my life and now they are telling us what to do in our own homes.

    Has there been any update in relation to this legislation being enacted this year?
